Mobile Flexi Bundles Terms and Conditions

  • Background

Mobile Flexi Bundles (hereinafter referred to as the “Offer” or “Flexi”) is a Product of Ghana Telecommunications Company Limited (trading as Telecel Ghana, and hereinafter referred to as “Telecel”).

  • All Telecel customers who participate in the Offer warrant that they have carefully read and fully understood these Terms and Conditions.
  • These Terms and Conditions are subject to Telecel Ghana’s general Terms and Conditions.
  • By accessing the Offer, the customer agrees to be bound by these Terms and Conditions.

 

  • Participation (Data Bundles)
  • The Flexi data offer is available to consumer mobile prepaid customers and select hybrid customers.
  • A customer can subscribe to Flexi data offers by dialling the USSD short code *700#, *110# and through My Telecel Play App.
  • Upon selecting “Flexi” customers will be asked to input any desired amount between GHs0.02 and GHs 999.99 in exchange for validity and no expiry data standalone allocations.
  • Customers can pay for the Flexi offer via airtime or Telecel Cash.
  • Flexi bundles with the same validity will aggregate and assume the validity of the most recent purchase. However, Flexi bundles of different validities or any other bundle will co-exist with one another and the bundle with the earliest expiry will assume usage priority.
  • Flexi offers do not auto-renew upon expiry; a subscriber needs to access any of the subscription channels to renew the offer.
  • Subscription onto any Flexi offer is charged per the price the customer indicated.
  • Allocations displayed in Gigabyte (GB) on the USSD menu, or My Telecel Play App is expressed in 2 decimal places. However, the actual allocation received will be based on the input price divided by the PPMB and PPM indicated in the table below.
  • When customers exhaust their Flexi offer allocation or the offer validity expires, they will be charged from their next priority offer. If the customers have no other offer, they will be charged 11.5p per MB for data (provided the customer has enabled PAYG browsing for Data).

  • Participation (Data & Voice Bundles)
  • The data and voice Flexi offer is available to consumer mobile prepaid customers and select hybrid customers.
  • Customer can subscribe to data and voice Flexi offers by dialing the USSD short code *110# and through My Telecel Play App.
  • Upon selecting “Flexi” customers will be asked to input any desired amount between GHs 0.07 and GHs 29.99 in exchange for no expiry data + voice + SMS combo bundles.
  • Customers can pay for combo Flexi offers via airtime or Telecel Cash.
  • After entering the desired price point, customers will be presented with three options to select from
  • Flexi combo bundles will roll over into another Flexi combo bundle and assume the no-expiry validity.
  • The Flexi offers can co-exist with other existing bundles and other Flexi bundles of different types and validity.
  • Flexi offers do not auto-renew upon expiry; a subscriber needs to access any of the subscription channels to renew the offer.
  • Subscription onto any Flexi offer is charged per the price the customer indicated.
  • The data component of the combo Flexi offer can also roll over into any no-expiry Flexi data (If present on the customer’s account).
  • Allocations displayed in Gigabyte (GB) on the USSD menu, or My Telecel Play App is expressed in 2 decimal places and voice allocations are rounded to the nearest whole number. However, the actual allocation received will be based on the input price divided by the PPMB and PPM indicated in the table below.
  • When customers exhaust their Flexi offer allocation or when the bundle expires, they will be charged from their next priority offer. If the customers have no other offer, they will be charged a Pay-As-You-Go (PAYG) rate of 13.2p per minute for local voice calls (Telecel and other local networks) and 11.5p per MB for data (provided the customer has enabled PAYG browsing for Data).

  • Limitation of liability
  • Telecel accepts no responsibility whatsoever for and without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control.
  • Telecel shall make commercially reasonable efforts to ensure that the benefits promoted as being available to members will actually be available as represented. However, Telecel does not guarantee or warrant that such benefits shall always be available. Telecel advises members to check availability of the desired benefits prior to redemption of the said benefits.
  • If for any reason any aspect of this Offer is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of Telecel which corrupts or affects the administration, security, fairness, integrity or proper conduct of this offer, Telecel may in its sole discretion modify or suspend the Offer. If an act, omission, event, or circumstance occurs which is beyond the reasonable control of Telecel and which prevents Telecel from complying with these Terms and Conditions Telecel will not be liable for any failure to perform or delay in performing its obligation.
  • Telecel reserves the right to suspend the Offer temporarily or permanently for legal, regulatory and for operational reasons (e.g., for repairs, planned maintenance or upgrades) whenever it is deemed necessary. Telecel undertakes where possible to restore the Offer as soon as practicable after any temporary suspension period. Telecel shall not be liable for any claims, losses or injuries whatsoever the Customer may suffer as a result any such suspension.

 

  • Disclaimer of Warranties
  • Telecel makes no warranty, implied or express, that any part of the Offer will be uninterrupted and error-free.
  • Neither Telecel nor any of its directors, employees, agents, or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any Customer for participating in the Offer.

 

  • Miscellaneous
  • A Telecel Customer’s continued participation in the Offer constitutes the member’s acceptance of any changes to these Terms and Conditions. Participants are responsible for remaining knowledgeable as to any changes that Telecel may make to these Terms and Conditions. Telecel will endeavor to make available the Terms and Conditions and any changes thereto on the Telecel website – www.Telecel.com.gh.
  • If Telecel or any Partner improperly denies a participant any benefits that the participant ought to have earned under the Offer, the participant’s exclusive remedy shall be the issuance of the improperly denied benefits by Telecel, if available, or such other reasonable, alternative and comparable benefits as determined by Telecel. In the event of any of the aforementioned improper denials, the liability of Telecel shall be limited to the value of the benefits concerned.
  • Participants are liable for any claims from third parties, including the tax authorities, arising from participation in this Offer.
  • Personal data relating to participants in this Offer that may be processed and used for purposes of the Offer shall be in accordance with applicable Data Protection Law.
  • Telecel reserves the right to terminate, suspend, cancel or amend the offer and these Terms and Conditions, reward structure, participation of any Telecel Customer in the Offer at any time. Any changes will be posted on the Telecel website and other online platforms and shall be binding on a Customer. Telecel will use all endeavours to minimize any effect on the consumer in order to avoid disappointment.
  • In the event of dispute regarding the interpretation of the Terms and Conditions, conduct and all other matters relating to the Offer the decision of Telecel shall be final and without appeal.
  • These Terms and Conditions will remain in full force and effect while the Offer lasts (not taking into account temporary suspensions of the Offer for operational reasons, e.g., for repairs, planned maintenance or upgrades).
  • These Terms and Conditions shall be governed by and construed exclusively in accordance with the laws of the Republic of Ghana.
