DREAM CAR PROMO- Terms and Conditions

Organizing Entity:  Telecel Ghana in partnership with Vasmol Limited.

Service Description

1.1.       Vasmol Limited (the Provider), will launch a new SMS based Trivia Game dubbed ‘My Dream Car Promo’ exclusively for Telecel subscribers.

1.2.       The Promo will run as a subscription-based SMS/WEB Trivia at a daily charge of GHS 2.00. All Subscribers are allowed to answer 4 base questions for the price of the subscription and at GHs 0.5 per question, extra unlimited questions daily with points allocated for both correct and wrong answers.

1.3.       With this trivia, questions are general knowledge based.  Upon a successful charge, the user is prompted with a daily reminder notifying him or her of; the successful charge and commencement of the day’s engagement by answering the questions.  After answering, User will subsequently receive three (3) additional questions summing up the questions tally to four (4).

1.4.       Then, User will be required to text the keyword EXTRA or click on an EXTRA button on the web portal to receive additional questions at GHS 0.50 each. The additional questions are unlimited in number.

1.5.       The Promo will run as a DAILY subscription SMS-based Trivia. Once Subscribers are billed they will be able to access the extra game to answer questions with points allocated for only correct answers.

1.6.       With these SMS/WEB and extra games, Subscribers can then compete for the prizes.

   2.                  Registration and Cancellation

2.1.       To subscribe and participate in the Promo, a Telecel User is required to send the communicated keyword, “START DCP” or “CAR” to short code 2018 at no charge to the User’s accounts or dial *2018# to subscribe. The GHS2.00 charge is applicable after completing the subscription process.

2.2.       To cancel the subscription at any time during the Promo period, the subscriber is required to send the keyword, ‘STOP DCP’ to the short code 2018 or dial *2018# to exit the Promo. Again, a subscriber can cancel subscription via the Subscription Manager by dialing *463# and following the prompts

Upon completing the cancellation request, the subscriber will lose all the points accrued. Customers who join the Promo are considered subscribers until they cancel their subscription.

2.3.       Vasmol, with express permission from Telecel, can also cancel a Subscriber’s subscription in the event of a clear expression of disinterest by the customer demonstrated through offensive and unrecognized SMS to the promo short code. (e.g. the Participant is sending a message reporting (“I do not want to participate”).

2.4.       Participants who cancel their subscription can re-subscribe at any given point in time during the Promo period by sending the defined subscription keyword(s) to 2018.

2.5.       The Organizer reserves the right to cancel or amend the Promo’s Terms and Conditions at any time. Any changes will be posted online on the Organizers’ website.

 

            3.                  Subscription Charges

3.1.       The daily subscription charge is GHS 2.00 (incl. Tax). Charging request of GHs 2.00 will be sent to all active subscribers on a daily basis. Subscribers who are all successfully charged will be notified with an SMS to commence the day’s activities.

3.2.       Telecel at its sole discretion may offer subscribers from time to time a discounted daily subscription charge.

3.3.       In case of repeated unsuccessful charges for 30 days/1 month, a subscriber will be deactivated from the promo at Telecel’s sole discretion.

3.4.       All SMSs sent to the short code 2018 will be at no cost to the subscriber.

The daily subscription charge gives you additional 100 points. Every correct answer comes with 100 points and points are accumulated during the lifetime of the promo.

           4.                  Promotion Duration

4.1.       The Promotion will have a duration of 180 days/6 months. The start date will be on Friday, August 1, 2025 at 12:00:00am local time and the date of completion will be on Saturday, January 31, 2026 at 23:59:59. (The Promo period).

4.2.       The Organizers with Telecel’s approval reserve the right to shift the commencement and completion date of the Promo. Subscribers will be notified in that event.

 

     5.                  Rewarding Periods, Prizes & Points

5.2.       Grand/final prize will be awarded at the end of the Promo.

5.3.       For every correct answer the Subscriber provides in the SMS Trivia, the Participant will receive 100 points.

5.4.       For every incorrect or invalid answer the Subscriber sends as a response to a question in the SMS Trivia, the Participant will receive varied points of 5 to 25.

5.5.       For every successful charge, a Subscriber will be allocated 100 points.  (Is this subscription or billing for questions0

5.6.       For every correct answer the Subscriber provides in the Extra Game, the Participant will receive 100 points.

5.7.          For every incorrect or invalid answer the subscriber sends as a response to a question in the Extra Game, the Participant will receive 0 points.

5.8. At any time during the Promo period, Telecel may introduce special challenges that offer subscribers bonus points to boost their chances of winning the prize.

5.9.       Special challenges samples: answering XX questions correctly in succession, answering XX questions correctly within a timeframe, bonus points for correct answers within another timeframe etc. Successful completion of daily challenges will come with bonus points to the subscriber.

5.10.   Points are cumulative through the Promo period.

5.11    The Grand Prize will be delivered within 120 days after the Promo period, at a time and place that will be disclosed to the winner within 30 days from the end of the Promo period.

  6.                  Winner Rules and Regulations

6.1.             Any customer who wins a cash prize in a week (eg. Week 1) will be ineligible to win same amount in the following week. (eg. Week 2) However, he can win the following week. (Week 3).Each eligible subscriber will be allotted a number of entries equivalent to the number of points accumulated by the end of the selection period.

6.2.             The grand prize selection will identify a winner and 9 runners-up, who will be entitled to become the winner in the event the first selected is unreachable.

6.3.             The winner will be contacted by Telecel on the mobile number used to participate in the Promo. Telecel will attempt to contact the winner at least 3 times a day over a period of 2  weeks  /14 days, between the hours of 8am and 5pm.

6.4.             A winner’s prize will be transferred to the next runner-up if the winner is unreachable after been contacted for a month.

6.5.             The winner is required to provide proof of eligibility and sign a prize acceptance form (as requested by Telecel) before prizes can be redeemed. If the winner fails to provide sufficient proof within that period, he/she is disqualified and forfeits the prize and the next runner up will be contacted.

6.6.             If the winner has any outstanding debts with Telecel, these need to be set off against the value of their prize winning(s), unless winner settles debt within 10 working days of being notified by Telecel.

6.7.             If the winner and all runner-ups forfeit the prize, the prize is deemed unclaimed and remains at the disposal of the Organizers.

6.8.             By accepting a prize, a winner consents to the use of his first name, initial of last name, city of residence, photograph and likeness in any promotional material produced by the Organizers. Such use does not entitle the winner to any further compensation.

6.9.             Any expense not explicitly indicated as part of the prize, including but not limited to insurance, travel expenses, accommodation, license fees or taxes, are the responsibility of the winner.

                                7.                Eligibility Rules

7.1.           The Promotion is open to residents of Ghana that are subscribers of Telecel, excluding all employees, representatives and agents of Vasmol and Telecel, their respective parents and/or affiliated companies, contest suppliers, and those with whom any of the foregoing are domiciled. The person that owns the SIM card or has express authorization from the SIM card’s owner to use it is considered the Participant, regardless of the actual user of the phone.

  • In order to be eligible for the Prize, subscribers need to have been successfully billed at least once within the Promo Period.

 

                              8.     Abuse and disqualification

8.1.             Subscribers are not allowed to use machines that send automatic SMS messages or automate/ facilitate the answer process or any other alternative of sending SMSs, other than the mobile phone. This prohibits the use of any GSM modems attached to a computer or mobile phones attached to a computer. Vasmol with the consent of Telecel has the right to disqualify any player reasonably suspected to have violated this obligation.

8.2.             Vasmol with the consent of Telecel may refuse to award the prize if any irregularities or fraudulent activities are detected in relation to clause 8.1 above.

8.3.             The Organizers with the consent of Telecel has the right to disqualify any subscriber under the suspicion of breaking this obligation.

 

                                9.     Telecel’s responsibilities

9.1.             Vasmol and Telecel are responsible for managing the Promo in addition to giving out the prizes to the selected winner(s).

9.2.             Telecel and the Organizer cannot be held responsible for any delay or impossibility of sending, receiving and/or billing SMS because of a technical problem. All the SMSs will be considered received by Telecel when they are registered in the Promo’s IT system and not when they are sent by the subscriber. All SMS will be considered received by the subscriber at the moment they are sent from the Promo’s IT system.

9.3.             Subscribers recognize and accept that the journal of the Promo’s IT System is the proof of the date, hour, minute and second of their receiving/sending each SMS message.

 

                                  10. Personal Data Protection

10.1.       By participating in the Promo, Subscribers expressly agree that personal data which they supply shall be processed by Vasmol for the purposes of executing the Promo and also for the purpose of publicizing the Promo and the Organizers. It is hereby specified that Vasmol guarantees that publicity, entailing the sharing with third parties of personal data supplied as a result of participation in the Promo, (including through television, the press, leaflets and other means and formats of communication) shall be made only with respect to the winner(s) of the Prize and will only indicate the given names and surnames of the winners, their place of residence, their images and voices (contained in photographic records, audio, video and other types of records, made with the purposes of publicity connected to the Promo).  The winning subscribers give, through their participation in the Promo, express consent for the use of this data in formats herein defined. Following the termination of the Promo, the personal data will be destroyed after 90 days.

 

10.2.       Subject to 10.1 and in accordance with local laws and regulations, Vasmol respects the privacy of the subscribers of this Promo, by which it is committed to the use of technology in a transparent form and in strict observance of the rights, freedom and guarantees of the subscribers and by the reservation of the intimacy of their private life. The personal data collected within the scope of this Promo will be treated as private and confidential. It shall not be disclosed to other individuals or organizations, except in the event of legislation to the contrary or where such is authorized by the Players themselves. The data will be stored on servers with access controlled on a need-to-know basis and limited by passwords. We may process the personal data of the subscribers as part of the Promo, in accordance with our customer Privacy Statement which can be found on the Telecel Ghana website or can be requested at any of our Retail Shops.

 

  1. Limitation of liability
  • Telecel accepts no responsibility whatsoever for and without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control.
  • The Organizers shall make commercially reasonable efforts to ensure that the benefits promoted as being available to Players will actually be available as represented. However, Telecel does not guarantee or warrant that such benefits shall always be available.
  • If a participant is improperly denied any benefits that the participant ought to have earned under the Promotion, the participant’s exclusive remedy shall be the issuance of the improperly denied benefits by Vasmol, if available, or such other reasonable alternative and comparable benefits as determined by Telecel and/or the Provider, where applicable. In the event of any of the aforementioned improper denials, the liability of Telecel and/or the Provider shall be limited to the value of the benefits concerned
  • If for any reason any aspect of this Promo is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of Vasmol which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promo, Vasmol with the consent of Telecel may modify or suspend the promo or invalidate any affected membership. If an act, omission, event or circumstance occurs which is beyond the reasonable control of Vasmol and which prevents Vasmol from complying with these terms and conditions Vasmol will not be liable for any failure to perform or delay in performing its obligation.
  • Telecel reserves the right to suspend the Promo temporarily or permanently for legal, regulatory and for operational reasons (e.g. for repairs, planned maintenance or upgrades) whenever it is deemed necessary.
  • Telecel undertakes where possible to restore the Promo as soon as practicable after any temporary suspension period.
  • Telecel shall not be liable for any claims, losses or injuries whatsoever the Customer may suffer as a result any such suspension.

 

  1. Indemnity

Vasmol shall indemnify and hold Telecel harmless against any claims, damage, loss, injury or disappointment suffered by a Customer through the participation in this Promo.

 

  1. Disclaimer of Warranties
    • Vasmol makes no warranty, implied or express, that any part of the promo will be uninterrupted and error-free.
    • Neither Telecel nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any customer for participating in the Promo.
    • By entering the Promotion, customers agree that no claim relating to such losses or injuries (including special, indirect, and consequential losses) shall be asserted or made against Telecel, its parent companies, affiliates, directors, officers, employees, or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or use of any prize, including without limitation, personal injuries, death and property damage.
  2. Miscellaneous 
    • A Player’s continued participation in the Promo constitutes the subscriber’s acceptance of any changes to these Terms and Conditions. Players are responsible for remaining knowledgeable as to any changes that the Organizers through Telecel may make to these Terms and Conditions. The Organizer will endeavour to make available the Terms and Conditions and any changes thereto on its website dreamhomepromo.com .
    • Players are liable for any claims from third parties, including the tax authorities, arising from participation in this Promo.
    • Personal data relating to players in the Promo will be processed and used for purposes of the Promo in accordance with applicable Data Protection Law. Personal data shall be used and exchanged by the Organizers.
    • Data Protection and Publicity – Telecel as a Data Controller may disclose Customers’ data to its contractors, agents, regulators, group companies, affiliates, or other third parties (data processors) in line with the Data Protection Act, 2010 (Act 843) to assist in conducting this Promotion or any future promotions.
    • The Organizers reserve the right to terminate, suspend, cancel or amend the offer and these Terms and Conditions, reward structure, participation of any subscriber in the Promo, or procedures at any time. Any changes will be posted on the website of The Organizers and other online platforms and shall be binding on a subscriber. The Organizers will use all endeavours to minimise any effect on the subscriber in order to avoid disappointment.
    • In the event of dispute regarding the interpretation of the Terms and Conditions, conduct and all other matters relating to the offer the decision of the Organizers together with Telecel shall be final and without appeal.
    • These Terms and Conditions will remain in full force and effect while the offer lasts (not taking into account temporary suspensions of the offer for operational reasons, e.g. for repairs, planned maintenance or upgrades).
    • These Terms and Conditions shall be governed by and construed exclusively in accordance with the laws of the Republic of Ghana
